Buyer Beware

The Residential Contract of Sale that is used in New York State includes a section on the property condition.  The following are excerpts from the standard contract, section 12, Condition of Property: "Purchaser acknowledges that Purchaser is fully aware of the physical condition and state of repair of the Premesis and of all other property included in this sale, based on Purchaser's own inspection and investigation..." "Purchaser shall accept the Property 'AS IS' in their present condition and state of repair..."      The Contract further states that it is the purchaser's responsibility to gather information about the house independent of any claims or representations made by the owner or real estate agent.
